You will not distribute, publish, send, or facilitate or permit the sending of unsolicited messages, promotions, advertising, or solicitations (such as "spam"), including commercial advertising and informational announcements that does not have the express permission of the end user.
You may not use, or encourage, promote, facilitate or instruct others to use, the Services for any illegal, harmful or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, or offensive. Prohibited activities or content include:
Any illegal activities, including without limitation any violation of laws or regulations relating to privacy.
Activities that may be harmful to others, our operations or reputation, including offering or disseminating fraudulent goods, services, schemes, or promotions, or engaging in other deceptive activities.
Content that infringes or misappropriates the intellectual property or proprietary rights of others.
Content that is defamatory, libelous, obscene, abusive, invasive of privacy, or otherwise objectionable, including content that constitutes pornography.
Content or other computer technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, time bombs, or cancelbots.
A message may not contain false information, including names or phone numbers. Any attempt by client to influence your account in order to achieve gain to which your are not entitled, including but not limited to exploiting undocumented features of an account or service, shall result in the immediate suspension of your account. You shall promptly repay CardBoardFish for the full amount of the value of any improper gain, which shall be determined by CardBoardFish.
Your use of the Services must comply with the Terms, Applicable Laws, rules and guidelines, including those of relevant government bodies, regulators, Service Providers and industry associations. CardBoardFish will not be held liable or responsible for any acts or omissions or otherwise occurring with Services that breach the Terms or this Policy.
You may not use the Services to violate or circumvent the security or integrity of any network, computer or communications system, software application, or network or computing device (each, a “System”), including without limitation accessing or using any System without permission, intercepting or monitoring data without permission, and falsifying transmission, termination or origination information regarding messages. Further, you many not facilitate the transmission or utilization of any viruses, worms, Trojan horses, or other code that might disrupt, disable, harm, erase memory, or otherwise impede the operation, features, or functionality of any System (or would permit a third party to do so).
You may not make network connections to any users, hosts, or networks unless you have permission to communicate with them, and you may not use the Services to impair or disrupt any users, hosts or networks, including through monitoring, crawling, denial-of-service attacks or any other interference.
You may not use the Services for services which are in direct competition with CardBoardFish or its Service Providers without prior written consent of the relevant party. This includes without limitation promotion of services for fixed or mobile telephony, provision of Internet subscriptions, broadband and datanetwork services, and mobile wallet solution services.
You may not deliver and terminate P2P traffic where your Terms do not expressly specify that such traffic is permitted. “P2P traffic” is traffic on the Services originated as an SMS on a handset and also terminates on a handset as an SMS.
You shall not poll for incoming delivery reports or incoming messages more frequently than once every 10 seconds, unless the response of the previous poll contains the maximum 100 delivery reports or incoming messages.
Where applicable, correct source address Type Of Number (TON) and Number Plan Indicator (NPI) settings, and correct source and destination address formatting, according to GSM specification, must be set for each message submitted to us. Failure to correctly set such settings and formatting may result in message delivery failure or the incorrect representation of the source address when it is displayed on the receiving device. We are not responsible for checking or modifying above-mentioned settings or formatting.
You must provide CardBoardFish no less than five (5) days* advance written notice of any promotion of any interactive use of the Services (including, without limitation, any TV voting service, or app-based messaging service) that is aimed at a wide audience and which could have an adverse effect on the a Service Provider’s network or the Services. Such notice shall include:
1. The likely volume of respondents;
2. The number of messages likely to be generated by you, the end users and CardBoardFish; and
3. The date and time by which end users can respond to the interactive use of the Services by sending a message.
CardBoardFish or the relevant Service Provider may, at its discretion, bar access to the use of the Services if it considers that it will have an adverse effect on the Service Provider’s network or the Services.
* No less than ten (10) days in Spain.
Access to any particular Service is subject to preliminary and ongoing due diligence, review and audit by CardBoardFish and its Service Providers, and you shall cooperate with such activities. CardBoardFish may block any message at its sole discretion.
We reserve the right, but do not assume the obligation, to investigate any potential violation of this Policy or misuse of the Services, and you shall provide your cooperation with such investigation. We may:
1. investigate violations of this Policy or misuse of the Services; or
2. remove, disable access to, or modify any content or resource that violates this Policy or any other agreement we have with you for use of the Services.
We may report any activity that we suspect violates any law or regulation to relevant law enforcement officials, regulators, or other third parties. Our reporting may include disclosing customer information and data. We also may cooperate with appropriate law enforcement agencies, regulators, or other third parties to help with the investigation and prosecution of potentially illegal conduct by providing network and systems information related to alleged violations of this Policy.
If you become aware of any violation of this Policy, you will immediately notify us and provide us with assistance, as requested, to stop or remedy the violation. To report any violation of this Policy, please email moc.hsifdraobdrac.proc@ecnailpmoc.
